1. Acceptance of Terms

Welcome to LoDo Pain LLC (“LoDo Pain,” “we,” “our,” or “us”). We are committed to providing accessible, evidence-based pain management through both telemedicine and in-office care.

 

These Terms of Service (“Terms”) govern your use of our website, telehealth platform, and in-person services (collectively, the “Services”).

 

By accessing or using our Services, you agree to be bound by these Terms and our Notice of Privacy Practices. If you do not agree, please do not use our Services.

2. Services Provided

LoDo Pain LLC (“LoDo Pain,” “we,” “our,” or “us”) provides pain-management and medication-management services on a direct-care, self-pay basis. Our services are offered through secure telemedicine visits and in-office appointments when required.

 

All services provided by LoDo Pain are considered non-covered services under Medicare, Medicaid, and other third-party payers. We do not bill or accept payment from any insurance plan or government program for our clinical, telemedicine, or administrative services.

 

By receiving care through LoDo Pain, you acknowledge and agree that:

  • LoDo Pain is a self-pay clinic. All fees—including setup fees, membership fees, and follow-up care—must be paid directly to the clinic before services are rendered.

  • LoDo Pain’s services include evaluation, consultation, care coordination, medication management, follow-up visits, and related support—but these are provided outside of Medicare or Medicaid coverage.

  • You understand that no claim for reimbursement will be submitted by LoDo Pain or on your behalf to Medicare, Medicaid, or any insurance carrier. You agree not to seek reimbursement from such programs.

  • LoDo Pain does not provide emergency or hospital-based services and does not replace the care of a primary-care or emergency-medicine provider.

  • Patients may still use insurance benefits separately for pharmacy, laboratory, or imaging services, as permitted by their plans. Those entities are not part of LoDo Pain’s billing or membership structure.

  • LoDo Pain’s membership and service fees represent direct-care payments for non-covered services designed to provide accessible, patient-centered care. These fees are not insurance premiums, do not provide insurance coverage, and may not be submitted for reimbursement under any insurance or government health-care program.

3. Medical Disclaimer

The content on our website or any related communications (emails, texts, or social media) is for informational purposes only and does not constitute medical advice.

If you are experiencing a medical emergency, call 911 immediately.

 

Your provider will make all clinical decisions based on your evaluation, history, and applicable medical standards.

4. Appointments and Telemedicine

Appointments are typically scheduled every four (4) weeks, though frequency may vary based on your treatment plan and clinical needs.

Telemedicine Visits

  • Conducted using HIPAA-compliant technology.

  • Patients must be physically located in Arizona at the time of their telemedicine appointment.

  • Telehealth has certain limitations, and your provider may require an in-person evaluation if necessary.

In-Office Visits

  • In-person visits may be required for specific medications, procedures, or follow-ups.

  • LoDo Pain utilizes shared, licensed office spaces for physical examinations when required or medical necessity.

5. Payment and Billing

LoDo Pain LLC operates exclusively as a self-pay, direct-care practice. All fees for consultations, memberships, and related services are paid directly by the patient at the time of enrollment or prior to each scheduled service.

5.1 No Insurance Billing

 

LoDo Pain does not bill, contract with, or accept payment from any insurance carrier, Medicare, Medicaid, or other third-party payer for any clinical or administrative services. All services provided are considered non-covered services under Medicare and Medicaid.

By receiving care from LoDo Pain, you acknowledge and agree that:

 

  • You are responsible for payment in full for all services rendered by LoDo Pain.

  • Neither you nor LoDo Pain will submit claims for reimbursement to any insurance company or government program.

  • You understand that no Medicare or Medicaid payments will be made for services provided by LoDo Pain, and you will not seek reimbursement from those programs for amounts paid to the clinic.

 

5.2 Membership Fees and Setup Charges

LoDo Pain offers membership-based pricing for ongoing care. Membership fees are charged on a monthly recurring basis and cover access to non-covered services such as telemedicine consultations, medication-management reviews, follow-ups, and care coordination.A one-time new-patient setup fee is required to establish care, which includes your initial consultation and onboarding. Setup fees are non-refundable.

5.3 Payment Methods

Accepted forms of payment include credit and debit cards. Patients who enroll in AutoPay receive a monthly discount as published on LoDo Pain’s website. You must maintain valid payment information on file to remain an active member.

5.4 Late Payments and Non-Payment

 

Membership fees are billed automatically on the 1st of each month and are due upon receipt. Failure to maintain payment may result in suspension or termination of services.Late payments may be subject to a $25 fee. Accounts more than 30 days overdue may be referred to a collections agency and subject to additional charges.

5.5 Refund Policy

The one-time setup fee to join LoDo Pain is non-refundable. This fee covers your initial consultation, record review, and onboarding.

 

Monthly membership fees are also non-refundable, as they secure ongoing access to care and provider availability for the billing period.

Approved administrative refunds (e.g., duplicate payments or billing errors) will be returned to the original payment method within 7–10 business days.

Payment-processing fees charged by merchant processors are non-refundable, and a 3% transaction adjustment may be deducted from all refunds to offset non-reversible credit-card costs.

5.6 Patient Responsibility for Third-Party Costs

 

Patients may choose to use their insurance benefits for pharmacy, laboratory, or imaging services provided by outside entities. Those costs are independent of LoDo Pain and are the patient’s responsibility. LoDo Pain does not manage, bill, or reimburse for such expenses.

5.7 Acknowledgment

By paying for or receiving services from LoDo Pain, you acknowledge that you understand and agree that all services are provided on a self-pay basis, are considered non-covered under Medicare and Medicaid, and are not eligible for third-party reimbursement.

6. Your Responsibilities

By using our Services, you agree to:

 

  • Provide accurate and complete information during intake and treatment.

  • Use telemedicine systems responsibly.

  • Follow your provider’s treatment plan.

  • Notify us promptly of any changes to your health, address, or payment method.

  • Comply with all controlled-substance agreements (if applicable).

 

Misuse of telemedicine, falsifying medical information, or using another person’s identity for care may result in termination of services and possible reporting as required by law.

7. Privacy and Data

Your personal and medical information is protected under federal and state privacy laws.

By using our Services, you consent to the collection and use of your information as described in these notices.

8. Conduct and Termination

LoDo Pain reserves the right to terminate care if a patient:

  • Fails to comply with their treatment plan or controlled substance agreement;

  • Engages in abusive, threatening, or disruptive behavior; or

  • Provides false or misleading medical information.

Termination will follow a written notice and reasonable opportunity for care transition.

9. Intellectual Property

All text, logos, images, and materials on LoDo Pain’s website and communications are the property of LoDo Pain LLC and may not be copied or used commercially without written permission.

10. Limitation of Liability

Our Services are provided “as is” and without warranties of any kind, express or implied.


To the fullest extent permitted by law, LoDo Pain and its affiliates are not liable for indirect, incidental, or consequential damages arising from your use of the Services.

Your sole remedy for dissatisfaction with our Services is to discontinue use.

11. Dispute Resolution

These Terms are governed by the laws of the State of Arizona.


Any disputes arising from your use of the Services shall be resolved through binding arbitration in Maricopa County, Arizona, under the rules of the American Arbitration Association.


You waive the right to participate in any class action or collective proceeding.
